Auction Terms & Conditions:
All tracts are leased through December 31, 2023 for a combination of row crop, pasture, and/or hay ground. Buyer(s) to honor existing leases. Tenant to have access to the growing crops. All tracts will be open after December 31, 2023.
There are no hunting leases on any of the tracts.
Tract 2, the house
United Fiber has been granted easement to trench fiber optic cable along Y highway in front of the house. Buyer to honor existing right to easement. Estimated to be completed by the end of 2023.
If tracts 1 and 2 sell to different buyers, the seller will provide and pay for a legal survey, prior to closing, to divide these tracts. If the winning bidder of tract 1 also wins tract 2, a survey will not be required or provided.
Tract 2, the house and estimated 3 to 4 acres, is offered as is, where is, no warranties expressed or implied. Tract 3
There is a parcel on the north side of Interstate 29, approximately 2.34 acres. This land locked parcel is EXCLUDED from the sale.
Tract 4, has two existing CRP contracts.

The winning bidder of tract 4 will be required to assume the existing CRP contracts and the responsibility and liability associated with the maintenance. Seller to retain the 2023 CRP payment and buyer to receive the 2024 payment.
The thorny locust trees on tract 4 are scheduled to be removed this Fall and the CRP fields sprayed for Sericea Lespedeza and Johnson Grass. The sellers are aware it is late in the season for spraying Sericea Lespedeza and a second application will be required in the Summer of 2024. The best time to spray Serica is after July 16th to the end of August. The sellers have obtained an estimate from Sure-Ag LLC to apply an application in the Summer of 2024 and will credit the buyer this amount at closing. The estimate is $35.39/ac multiplied by 12.3 acres for a total cost of approximately $435.30. This amount will be credited to the new owner at time of closing.
Any personal property items remaining on the property at the time of closing will become the property of the winning bidder.
This is an online only auction. Tracts will be offered individually, and auctioned in order as they are numbered beginning with tract 1, then 2, and so on. We will NOT offer an option to combine all tracts at the conclusion of the bidding.

Each Tract will end with a soft close, meaning that a bid in the final minute will extend bidding by approximately 5 minutes.
Tract 1 will begin ending at approximately 10:00 am.

Bidding on tract 2, the house, will be a total dollar amount. Bids placed on tracts 1, 3, & 4 will be on a per acre basis (your bid times the total acres).
Bidders will be required to register and sign terms/conditions before bidding on the auction.
Bidders are required to register 24-hours prior to open bid.
The successful high bidder, upon completion of the Real Estate Auction, must complete and sign a purchase agreement, and any seller disclosures provided by the seller, and render 10% of the purchase price (earnest money) as a non-refundable deposit in the form of a personal check, business check, certified funds or wire payable to Closing Company. Balance due at final closing.
Premier Land & Auction Group LLC / Real Broker, LLC must receive a signed copy of the contract (hand delivered, faxed, or scanned and emailed) within 24-hours after the buyer has been notified that the sellers have accepted his or her bid. The sellers shall have the right to accept or reject any and all bids. Once accepted, this agreement shall be binding on the parties and their successors and assigns.
This agreement is NOT subject to financing, inspections, or other contingencies or delays to the closing for such a reason. Out of area personal checks must be with the approval of the Auction Company personnel. Anyone not known by the Auction Company or sellers may be required to show proof of Bank Letter of Credit. Sales are non-contingent; failure to close will result in forfeiture of the earnest money.
Buyer must secure their own necessary financing approval prior to the auction. Sale is subject to owner confirmation and reserves the right to accept or reject any and/or all bids.
The property is sold “As Is, Where Is” and no warranty or representation, either expressed or implied concerning the property is made by the seller or Auction Company. Please inspect the property before bidding.
Sellers and/or the Auction Company do not guarantee acres. Taxes will be pro-rated to the day of closing. Guaranteed Marketable Property Title to prospective buyer. Seller shall provide an Owner’s Policy of Title Insurance in the amount of the purchase price and shall execute a proper deed conveying the real estate to the buyer.
